Terms of Service

The service

TalkTok lets you build an AI chatbot that answers your customers' questions from the information you provide, and share it by link or website widget. We may improve, change or discontinue features, and we will try to give notice of major changes.

Your account

You must give accurate information, keep your sign-in details secure and be responsible for activity under your account. Tell us promptly at info@talktok.ai if you suspect unauthorized use.

You must be at least 16 years old and able to form a binding contract.

Your content

You keep ownership of the content you provide ("Your Content"). You give us a limited license to host, process and display it, and to send it to our AI provider, only to run the service for you.

You are responsible for Your Content and for having the right to use it. Do not include anything unlawful, infringing, deceptive or harmful, and avoid sensitive personal information.

Acceptable use

Do not misuse the service: no attempts to break, overload or probe it, bypass limits, scrape it, or use it to send spam, impersonate others, spread malware, or mislead people.

Do not use the chatbot to give medical, legal or financial advice that should come from a qualified professional, or in a way that creates a safety risk.

We may suspend or remove accounts or content that break these terms or put the service or others at risk.

AI answers

The chatbot answers using AI based on the content you provide. We work to keep answers accurate and to say when information is missing, but AI can make mistakes. You are responsible for reviewing your content and for how you rely on answers shown to your customers. Answers are not professional advice.

Plans, billing and cancellation

Paid plans are subscriptions billed monthly in advance through Stripe, and renew automatically until cancelled. Plan limits (such as monthly chats, training items and languages) are shown on the pricing page. When a monthly limit is reached the chatbot shows a short notice until the next month or until you upgrade.

You can change or cancel your plan at any time in the billing portal. A cancellation takes effect at the end of the paid period, and you keep paid features until then. Plan changes that increase your plan are charged pro rata immediately; decreases take effect at the end of the billing period.

Except where the law requires otherwise, fees already paid are not refundable. We may change prices with advance notice before your next renewal. Taxes may apply.

Availability

We aim for a reliable service but do not guarantee uninterrupted or error-free operation. We may suspend the service for maintenance or security.

Intellectual property

TalkTok and its software, design and branding belong to us or our licensors. These terms do not give you any rights to them except the right to use the service.

Disclaimers and limits of liability

The service is provided "as is" and "as available", without warranties of any kind to the extent the law allows.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Ending the relationship

You may stop using TalkTok and delete your account at any time. We may suspend or end your access for breach of these terms. Sections that by their nature should survive (for example ownership, disclaimers and liability) will survive.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Courts located in Alberta have jurisdiction, except where the law of your country gives you the right to use your local courts.

Changes and contact

We may update these terms; for important changes we will give notice. Continuing to use the service after a change means you accept it. Questions: info@talktok.ai.
